Текст оригинала - русский 1.1 Ни одна Сторона не вправе без предварительного письменного согласия других Сторон уступать все права (интересы) или их часть по настоящему Меморандуму, предоставлять в отношении них любые обеспечительные права, передавать в доверительное управление или иным образом передавать их.
1.2 Лица, не являющиеся Стороной настоящего Меморандума, не имеют права по Закону о контрактах (правах третьих сторон) 1999 г. требовать исполнения любых положений настоящего Меморандума в судебном порядке или пользоваться преимуществами настоящего Меморандума.
1.3 Изменения настоящего Меморандума имеют силу только в том случае, если они составлены в письменной форме и подписаны каждой из Сторон или от ее имени.
1.4 Каждая из Сторон оплачивает все затраты, понесенные ею в связи с подготовкой, обсуждением и подписанием настоящего Меморандума и предусмотренных им соглашений.
1.5 Настоящий Меморандум может быть подписан в любом количестве экземпляров, все из которых совместно составляют единый документ. Любая Сторона вправе заключить настоящий Меморандум, подписав один такой экземпляр.
1.6 Настоящий Меморандум содержит полную договоренность между сторонами относительно предмета настоящего Меморандума на дату его заключения, и заменяет собой любые предшествующие письменные или устные соглашения между Сторонами.
Перевод - английский 1.1 No Party shall be entitled without the prior written consent of the other Parties to assign all or part of its rights (interests) under this Memorandum, grant any security rights in relation to them, transfer them into a management trust or transfer them in any other way.
1.2 Persons who are not Parties to this Memorandum shall have no rights under the Law on Contracts (Third Party Rights) of 1999 to enforce the performance of any of the provisions of this Memorandum through the courts or to take advantage of the benefits of this Memorandum.
1.3 Amendments to this Memorandum shall take effect only if they are drawn up in writing and signed by each of the Parties or on their behalf.
1.4 Each of the Parties shall pay all costs incurred by it in connection with the preparation, discussion and signing of this Memorandum and the agreements it envisages.
1.5 This Memorandum may be signed in any number of copies, all of which shall together make up an indivisible document. Any Party shall be entitled to execute this Memorandum by signing one such copy.
1.6 This Memorandum contains the full agreement between the parties on the subject of this Memorandum at the date of its execution, and replaces any previous written or oral agreements between the Parties.

Довольно странно, что энергетическая проблематика вместо темы, принципиально объединяющей всю Европу (к которой географически, исторически, культурно, ментально относится Россия), превратилась в последние годы в проблему, которая континент разъединяет, порождает точки напряженности, на дезактивацию которых приходится тратить немало усилий и средств. Странно это потому, что мы имеем тут классический случай взаимной и равной зависимости потребителя и поставщика и очевидный взаимный экономический интерес. В свое время эти факторы привели к знаменитому проекту «газ-трубы» между СССР и Западной Европой, реализация которого послужила толчком к кардинальным переменам во всем международном климате.
Сегодня же, вместо обсуждения того, как создать единую энергосистему Европы (или даже Евразии), т.е. моделей будущего, мы размышляем, как построить механизмы взаимного сдерживания и страхования, т.е. модели прошлого. Эта абсолютно противоестественная, на мой взгляд, ситуация, противоречащая и здравому смыслу, и экономической выгоде, возникла потому, что происходит гипертрофированная политизация энергетической проблематики. Выгодно ли это России? Те, кто хорошо знает ситуацию в стране, планы ее руководства по модернизации, практически, всего государства – от механизмов управления до экономики – однозначно скажут вам, что России сейчас совсем не до этого. Но ведь для чего-то нужно пугать европейского обывателя «авторитарным газовым медведем с Востока», который «питается молодыми демократиями»?

It is quite strange that, instead of uniting the whole of Europe (to which Russia belongs geographically, historically, culturally and psychologically), the question of energy has, in recent years, become an issue dividing the continent. It is a source of tensions that requires considerable efforts and resources to defuse. It is strange because we have here the classic case of a consumer and a supplier who are equally dependent upon each other and who share an obvious economic interest. At one time, this led to the famous ‘natural gas pipeline’ project between the Soviet Union and Western Europe. Implementation of this project provided the impetus for a sea change in the international climate.
These days, however, instead of working out how to create a unified European (or even Eurasian) energy system – that is, a model for the future – we dwell on how to construct mechanisms of mutual control and insurance – models of the past. This completely unnatural situation, which flies in the face of both common sense and economic interest, has arisen because the energy issue has become excessively politicised.
Does Russia stand to gain from this? Those aware of the situation in our country and the leadership’s plans to modernise virtually the whole state – from the mechanism of government to the economy – will tell you straight that Russia really has no time for such games at present. What on earth is the point of scaring the average European with the “authoritarian gas bear from the East” who “feeds on fledgling democracies”?
I am a Cambridge University languages graduate and qualified solicitor with over four years’ post qualification experience within the legal profession (in London and Moscow). I have a solid background in translation and now specialise in the areas of law and business. I began working freelance for agencies and direct clients in Moscow and have continued to do so since relocating, in 2004, to the UK. Significant direct clients, past and present, include the Moscow offices of Allen & Overy and UNICEF, Chatham House’s Russia and Eurasia Programme, and leading Russian parliamentarian Andrey Klimov.
In 2007 I sat the Chartered Institute of Linguists’ Diploma in Translation, passing with distinctions in the general and legal papers and a merit in the business paper. The eight years I spent in Moscow (1990-2 and 1998-2004) gave me considerable direct experience of post-Soviet Russia and an appreciation both of language and its context. This, together with my legal experience, makes me extremely well qualified as a legal translator. As a former lawyer, I put a premium on accuracy and clarity. I am enthusiastic, organised and committed to producing excellent work on time, every time. I am an associate of the Institute of Translating and Interpreting and in March 2009 was made a full member of the Chartered Institute of Linguists.
