The buyer is obliged to examine each Delivery immediately upon arrival. Any apparent defects (including damage in transit), incompleteness of the goods or any other variances from the confirmation of the order have to be notified immediately upon arrival of the Delivery at the destination in writing by specifying the defect, incompleteness or other variances, and quoting the invoice number.
Any hidden defects (including defects surfacing during manufacturing) have to be notified immediately after discovery. It shall be assumed that hidden defects are normally detectable within a period of sixty days after arrival unless the buyer is able to prove that it could not have reasonably detected the defect within that period.
Defective products must be kept available for the Seller’s inspections for 14 days from the date of the notification and must not be returned to the Seller earlier. Upon Seller’s request, specimens of the goods found faulty must be sent back to the Seller.

Про будь-які видимі недоліки (в тому числі пошкодження при перевезенні), неукомплектованість товарів або будь-які інші відхилення від підтвердження замовлення необхідно письмово повідомити відразу після прибуття Поставки в пункт призначення із зазначенням недоліку, неукомплектованості або інших відхилень і посиланням на номер рахунка-фактури.
Про будь-які приховані недоліки (в тому числі недоліки, що виникли під час виготовлення) необхідно повідомити відразу після виявлення. Передбачається, що приховані недоліки, як правило, виявляються протягом шістдесяти днів після прибуття, якщо покупець не зможе довести, що він обґрунтовано не міг виявити недолік протягом цього періоду.
Продукція з недоліками повинна зберігатися для перевірок Продавцем протягом 14 днів з дати повідомлення і не повинна повертатися Продавцю раніше. На прохання Продавця, зразки товарів, що виявилися бракованими, повинні бути відправлені назад Продавцю.

In the event Landlord cannot deliver possession of the Premises to Tenant upon the commencement of the Lease term, through no fault of Landlord or its agents, then Landlord or its agents shall have no liability, but the rental herein provided shall abate until possession is given. Landlord or its agents shall have thirty (30) days in which to give possession, and if possession is tendered within such time, Tenant agrees to accept the demised Premises and pay the rental herein provided from that date. In the event possession cannot be delivered within such time, through no fault of Landlord or its agents, then this Residential Lease Agreement and all rights hereunder shall terminate.

Текст оригинала - английский 144. The Court reiterates the difference in nature of the interests protected by Articles 6 and 8 of the Convention. While Article 6 affords a procedural safeguard, namely the “right to a court” in the determination of one’s “civil rights and obligations”, Article 8 serves the wider purpose of ensuring proper respect for, inter alia, family life. The difference between the purposes pursued by the respective safeguards in Articles 6 and 8 may, in the light of the particular circumstances, justify the examination of the same set of facts under both Articles (see Sylvester v. Austria, nos. 36812/97 and 40104/98, § 76, 24 April 2003, with further reference).
145. The Court further reiterates that Article 6 of the Convention does not guarantee the right to appear in person before a civil court, but rather a more general right to present one’s case effectively before the court and enjoy equality of arms in relation to the opposing side. Article 6 § 1 of the Convention leaves to the State a free choice in the means to be used in guaranteeing litigants these rights. The Court should establish whether the applicant, a party to civil proceedings, was given a reasonable opportunity to have knowledge of and comment on the observations made or evidence adduced by the other party, and present his case in conditions which did not place him at a substantial disadvantage vis-à-vis his opponent.

I have a degree in both translation/interpreting and law. I have been working in the field of legal translation for 6 years, two of which at Kyiv Office of Baker&McKenzie. Before that I worked as a legal translator-editor at Profpereklad (one of the largest translation services providers in Ukraine and Eastern Europe) and as freelance translator at Task Force, Geftranslators and TranslateIt.
My principal objective is to deliver high-quality translation. In order to achieve this, I always use dictionaries, encyclopedias, project-specific glossaries, style guides, follow translation standards and client-specific instructions provided.
Main CAT tool I use is SDL Trados Studio 2017, but I also worked in MemSource, MemoQ and SmartCAT.
