This morning the European Parliament's Environment Committee voted on the draft Cosmetics Regulation. The result is very good for us as Unilever as the large majority of the amendments we had put forward/supported were accepted (on nano, CMRs, claims)!

Pending a more detailed analysis of the detailed results of the vote, here are the key points for us:

Nanomaterials
- An acceptable definition of nanomaterials was adopted. The Commission must adapt this definition within 18 months of the entry into force of the Regulation to take account of technical and scientific developments.
- Our proposal for the notification of nanomaterials was accepted and consists of the following: for all existing nanomaterials, a notification is made to the Commission taking into account the specific exposure conditions, a status report is published on all nanomaterials used and their exposure conditions, in case of doubts, the Commission requests the SCCP to give its opinion on the safety of these nanomaterials; the Commission then adopts a decision on the authorisation of the product raising concern. For the new nanomaterials, a pre-notification scheme would apply; the responsible person also submits the safety assessment related to the specific nature of the nanomaterial and taking into account the specific exposure conditions to the Commission upon request. The Commission may request the opinion of the SCCP.
- An annual report will be submitted to the European Parliament and the Council updating the latest developments in the use of nanomaterials in cosmetic products. The provisions of this regulation concerning nanomaterials should be reviewed every 5 years in the light of scientific progress.
- INCI prefix labelling of nanomaterials was adopted.

CMRs
- An amendment by the Greens was adopted and is acceptable to us. CMRs may be used exceptionally in specific products when they fulfill the following conditions (in addition to those laid down in the original Commission proposal): evaluation and agreement on safety by the SCCP taking into account the global exposure from other significant sources as well as taking particular account of vulnerable groups.

***Product claims***
- The Commission shall establish an action plan regarding claims in cooperation with Members States.
- After consultation of the SCCS if appropriate or other relevant authorities, the Commission shall adopt a list of common criteria for claims which may be used in cosmetics products.
- The Commission shall submit to the European Parliament and to the Council a report on the use of claims on the basis of the common criteria.

Link with REACH
- Unfortunately our amendment regarding the need to have a clear link to REACH to ensure the safe use of substances in cosmetic products was not adopted.

Next steps
- The Parliament and the Council need to negociate in the next few weeks if they want to reach a 1st reading agreement, and have this voted in EP plenary early next year. The EP rapporteur, whose amendments mainly got rejected in today's vote, is not keen to defend an EP position she considers difficult - so it remains to be seen how the negociations with the Council will proceed.
- The Council Working Group meets on 5 Dec and will discuss mainly nanos - and try to form the Council view on the amendments adopted in the EP today. ACTION for LTMs: if possible, please contact your national authority before 5 Dec and continue to reinforce the view we have been pushing in Council (Colipa position on simple pre-notification).
