I always read carefully a NDA before signing it (or any other document for that matter), so if it contains my signature I will not break it, but I must say that I have declined signing a few NDAs because of some pretty nasty clauses…

A few times I can think of, mostly in the interest of the client.


I have discussed use of a client's proprietary tool (BREACH OF NDA!!!) with a colleague working on the same tool so we could get our jobs for this client done in time.

I have made offline copies of online content (BREACH OF NDA!!!) for proofreading purposes.

I have not immediately destroyed all files relating to a project from my computer after delivery (BREACH OF NDA!!!) because I kne

I may have done so, but not in an end-of-the-world really serious with consequences kind of way.

PS: I can't recall ever actually signing an NDA per se, although I suppose I must have done so at least two or three times in the past couple of decades…

Nope it's not, if the company chooses to make certain information publicly available, then this information is not protected by the NDA anymore - there is nothing to protect!

I carefully read all NDA's to determine whether or not I might get into a situation where a breach might occur. Usually we change anything that might lead to a breach, e. g. contact any of their clients during a certain period of time.This is changed to: not to contact anyone known to me as being one of their clients.

I'm old-fashioned, my given word must be honored, even more so when I sign my name to any document.

... but I have not always erased the files on my computer. I like to keep my past work for consultation purposes. It often comes in handy.

I was working on something in which my husband is an expert. I asked the client if I could consult him, and the client agreed.
So, technically, I broke the written letter of the NDA, but I had permission.

I am rarely given any such contract to sign, less than a handful in almost 3 decades. But I do have a code of ethics to adhere to as a certified translator and have always respected that.

I have never broken a NDA agreement. I have had clients come back after translating or finishing voice over projects and ask me to sign a NDA after the project has been finished. Anyone else?

One more instance:

My wife helps me with bookkeeping and has access to a list of all the projects I'm working on, including name, rate information etc. -- BREACH OF NDA!!!


(I can't imagine the current 85% No will hold up to real scrutiny... I think we need a second referendum here!)

Of course no one would likely admit that publicly.

I've had a few clients of clients look for me when they found out who I was, trying to negotiate directly with me for better rates. When that happens, I deny the proposal and inform the primary cient immediately of that attempt. Working with ethics is not a matter of being afraid of being punished. It's a matter of consciousness. I like to get to bed and sleep deeply.

PS: Just remembered two exceptions here:
1. I do not erase anything from my TMs. I erase documents when the clients require it, but the TMs are my right, my intellectual property, and will always remain untouched. So the entire documents that were erased from the folder are still there anyway.
2. I do mention big clients I have worked indirectly for in my CV and profiles. It's also my right, I have evidence of it, and I do not consider I'm breaching any NDA by doing that.
