Bus/Financial - Real Estate / Mortgage contract
French term or phrase: cédules hypothécaires de registre
I am translating a mortgage contract, and the document refers to "cédules hypothécaires de registre" as somewhat of a fixed term (although there is a deviation below, as you can see):

Here is my attempt at a translation:

The owner(s) of the building(s) to be used as collateral undertake(s) to transfer as collateral to the Bank the mortgage notes described below, either in bearer or registered form, or else as registry mortgage notes. The Bank acquires full ownership of the paper Mortgage Notes and full title to the registry Mortgage Notes on a fiduciary basis. ... If the Mortgage Notes are in the register, the Collateral Provider is obliged to apply (or to have applied) the entry in the Land Register to the Bank or its trustee as holder of the Mortgage Notes, and authorises the Bank to apply for its own entry as necessary.

My question, then, is if there is a better English term than "registry mortgage notes", which I have to revise later to "mortgage notes in the register".

neutral  Adrian MM.: My first thought, too.Trouble is the asker seems to be in the UK where a mortgage cert. is confusable with a one-off 'charge cert.' https://mortgagerequired.com/news/what-is-a-charge-certifica... // Mine is not a disagree, but a UK conveyancing 'caveat'.

mortgage certificate in the from of / as registry entry

Explanation:
Si les Cédules hypothécaires sont de registre

literally:

If the Mortgage Notes "are of the Registry type" ...

i.e.

If the Mortgage Notes exist in the form of entries the register

IOW it's the case when the ONLY "proof / record" of the existence of the lien on the property is a mention / entry in the Registry.

neutral  Steve Robbie: Your point is that - here - the distinction is between "cédules sur papier" and "cédules de registre"? The Q. is then whether, in practice, sur papier = au porteur. Because if so, the selected answer is usable anyway.
