Masz rację mike, w przypadku spraw imigracyjnych zawsze będą jakieś warunki zwolnienia.

Skoro postanowienie wcale nie musi wejść w życie to może warto ująć to w tłumaczeniu i napisać "postanowienie wstępne".

Osobiście nie jestem zwolennikiem tłumaczenia "bail" jako "kaucja", ponieważ w UK "bail" odnosi się do warunków jakie musi spełnić zwalniana osoba. Nie jest wymagane wpłacenie sumy pieniędzy (patrz definicja wyżej). Niemniej bardzo wiele źródeł podaje takie tłumaczenie.

Poprawka: jeżeli mówimy o conditional bail to w grę wchodzi także kaucja/poręczenie majątkowe (jako jeden z możliwych warunków). Ale "bail" może też być "unconditional" i wtedy nie ma żadnych warunków zwolnienia.

Bail conditions should only be imposed in order to address any of the risks that would be inherent in granting unconditional bail.
