La empresa española ELECTRO-JET, muy conocida en el mercado internacional por sus equipos de limpieza, instalaciones de transporte de bobinas y sistemas de paletización automáticos de cajas y conos, hace pocos años lanzó al mercado una nueva mechera ROVEMATIC . Esta máquina está disponible tanto en versión semiautomática (AF) como en una versión completamente automatizada (llamada ADR). Incorpora varios avances técnicos y es capaz de hacer el cambio de mudada en 90 segundos, independientemente del número de husos de la máquina.

The Spanish company ELECTRO-JET, widely known in the international market for their cleaning equipments, bobin transports installations, and boxes and cones automatic palletising systems, launched a new ROVEMATIC roving frame into the market some years ago. This machine is available both in a semiautomatic version (AF) and in a completely automatic version (called ADR). It incorporates several technical advances and it is capable of performing the doffing in 90 seconds, regardless of the spindles number of the machine.
Though a lot of these machines are already working all over the world, ELECTRO-JET has foreseen to exhibit a ROVEMATIC ADR roving frame in net ITMA show, that will take place in Munich, Germany, and which will be held during the month of September 2007.
Together with these machines, Electro-Jet will also show several of their travelling cleaners, and also their bobbins and cones transport installations, their packing systems and their cones and boxes palletising automatic lines.
All these machines may be seen in full operation in the stand, in order to show precisely the real possibilities of their use in the mill.

Source text - English TRANSPORTE AUTOMÁTICO DE BOBINAS
Los sistemas automáticos de transporte permiten automatizar y racionalizar el trabajo de transporte de bobinas en la hilatura, desde un grado medio bajo de automatización hasta la automatización total. Para ello Electro-Jet dispone de 2 tipos básicos de transporte, el llamado TAC y el TAB. El sistema TAC se utiliza en fábricas con producciones estándar y poco cambiantes, puesto que la asignación entre máquinas es fija. Cuando se opta por este sistema, se instalan unas cadenas de transporte montadas sobre la zona de las continuas, y otras montadas sobre la zona de las mecheras. En un punto intermedio entre ellas se instala una denominada estación de transfer, que se encarga de traspasar las bobinas de una cadena a la otra.
Para instalaciones que necesiten mucha más flexibilidad en cuanto a la asignación entre máquinas, se ha desarrollado el sistema TAB. Este sistema permite la conexión variable entre las máquinas de producción, funcionando de forma totalmente autónoma, y siguiendo las instrucciones dadas en el programa informático preestablecido. Tanto las órdenes como la asignación entre las máquinas se puede variar a través del teclado de un ordenador.
Cuando la altura de la fábrica así lo permite, se pueden instalar las zonas de stock aéreas en distintos niveles superpuestos. Ello permite que se pueda reducir el espacio en planta destinado a almacén de bobinas, ampliándose así el espacio libre en la fábrica.
PALETIZADOR CENTRALIZADO
Cuando la producción así lo requiera, se puede instalar un único paletizador, capaz de paletizar los conos que le lleguen a través de las distintas cadenas o cintas de transporte, paletizando solo los conos de la calidad que en cada momento se le indique. Antes de llegar a la zona de paletización, se instalan unas líneas de stock, que se encargan de mantener los conos separados por calidades, antes de proceder a su paletización.
TRANSPORTE DE CONOS Y LINEAS AUTOMÁTICAS DE PALETIZACIÓN
Para conseguir una automatización total, se puede instalar un cargador a la salida de cada una de las máquinas, para que pueda cargar los conos a la cadena de transporte. Los conos que van circulando en esta cadena pueden pertenecer a distintas calidades de hilo, y los cuelgues memorizan la calidad que están transportando hasta que los descargan en la línea de paletización que les corresponde. En esta línea de paletización se pueden encontrar distintos palets (correspondiendo a distintas calidades) que se van formando al mismo tiempo, a medida que van llegando los conos. Este sistema permite el transporte y la paletización de los conos, sin ningún tipo de intervención manual, lo que permite evitar eventuales errores humanos en la clasificación y paletización de los conos.
The automatic transport systems allow the automation and rationalization of the bobbins transport work at the spinning, from a low level of automation to a total automation. For this Electro-Jet disposes of 2 basic transport kinds, the one called TAC and the one called TAB. The TAC system is used in mills with standard and few changing productions, as the assignation between machines is fixed. When we choose this system, some transport chains are installed, some of them erected over the ring spinning frames and the other ones over the roving frames. In an intermediate point between them there is a called transfer station installed, which transfers the bobbins from one chain to the other one.
For installations that may need a lot of flexibility with regards to the assignation between machines, a TAB system has been developed. This system allows the variable connection between the production machines, working in a complete autonomous way, and following the instructions given in the pre-established computer programme. Both the orders and the assignation between machines can be changed through a computer keyboard.
When the mill height allows it, the overhead stock areas can be installed at different superimposed levels. This allows the reduction of the plant space for bobbins storage, increasing this way the free space at the mill.
CENTRALIZED PALLETISER
When the production requires it, a sole palletiser can be installed, being capable to palletise all the cones that arrive through the different transport chains or belts, palletising only the cones of the quality indicated at every moment. Before arriving at the palletising area, there are some stock lines installed, which take charge of keeping the cones separated by qualities, before proceeding to its palletising.
CONES TRANSPORT AND AUTOMATIC PALLETISING LINES
In order to obtain a total automation, a charger can be installed at the exit of every one of the machines, so that it can charge the cones to the transport chain. The cones that circulate on this chain may belong to different yarn qualities and the bobbin holders memorise the quality that they are transporting till they discharge them at the corresponding palletising line. In this palletising line different pallets can be found (corresponding to different qualities) that are formed at the same time, as the cones arrive. This system allows the cones transport and palletising without any kind of manual intervention, which allows to avoid any possible human error in the cones classification and palletising.

FINANCIAL RELIEF IN DIVORCE AND SEPARATION CASES
Introduction
6.1 The broad areas in which the 1996 Act affects ancillary relief are set out in s 15(2). This provides that:
“The main object of Schedule 2 [wich amends that part of the MCA 1973 dealing with financial relief ] is –
(a) to provide that, in the case of divorce and separation, an order about financial provision may be made under that Act before a divorce or separation order is made; but
(b) to retain (with minor changes) the position under that Act where marriages are annulled.”
Section 15(3) goes on to say that Sch 2 also makes minor and consequential amendments to the 1973 Act connected with the changes mentioned in subsection (1).
In fact, the changes effected by the Act are more extensive than might appear from the objects mentioned in s 15(2), and these must be examined in detail. The changes relating to pensions are discussed at para 6.28.
To assist the reader to understand the full extend of these amendments, the Matrimonial Causes Act 1973 is set out in this amended form in Appendix 2.
6.2 The first of the changes is in respect of the arrangements for the future. One of the underlying principles of the Act is that the parties should have dealt with their financial and other arrangements during the period for reflection and consideration, and, as was seen in Chapter Four, that an applicant for a divorce order must produce to the court either a court order or negotiated agreement relating to financial issues, or must satisfy the court, in effect, that this is not practicable. It is intended, therefore, that financial disputes are to be resolved before the making of a divorce order. This is a reversal of the pre-1996 position; it has already been considered in detail in Chapter 4.
Section 15(2) does not, therefore, give the whole picture when it says that an order about financial provision “may be made… before a divorce order or separation order is granted”, the truth is that any such order must be made unless the applicant falls within some exception to the rule.
6.3 The “minor and consequential amendments” referred to in subsection (3) deal principally with the orders which the court can make, and when they should take effect. Under the pre-1996 law, it was necessary to have a decree nisi before an order of a capital nature could be made, and a decree absolute before it could take effect. This has all had to be reconsidered.
There are provisions in the Act which deal with pensions, and these will have to be considered. Finally, the potentially important changes as to the conduct of the parties must be discussed.
6.4 The matters to be dealt with in this chapter are, therefore, as follows:
(a) orders which the court may make;
(b) the time when orders may be made, and when they may take effect;
(c) new provisions as to variation;
(d) new provisions as to pensions;
(e) new provisions as to conduct;
(f) procedure
It must be emphasised that this is not a comprehensive text on financial relief; the matters covered in this chapter relate only to changes brought about by the 1996 Act, and matters closely associated with such changes. The references to the 1973 Act are, of course, references to the Act as amended by the 1996 Act.
Orders which the court may made
6.5 Section 21 of the Matrimonial Causes Act 1973 now provides for two classes of orders for financial relief, namely, financial provision orders and property adjustment orders.
“Financial provision orders” comprise the following:
(a) periodical payments orders;
(b) secured periodical payments orders;
(c) orders for payment of a lump sum (lump sum order).
“Property adjustment orders” comprise:
(a) an order for transfer of property to the other party or to a child;
(b) an order for settlement of property;
(c) an order for variation of settlement;
(d) an order extinguishing or reducing an interest in a settlement.
This does not change the substance of the previous law. However, there are changes in detail.
When can orders be made?
6.6 Any of these orders may be made at “the appropriate time” (MCA 1973, s 22A(1) and s 23A(1)). The appropriate time is defined by s. 22A(2) as any time:
(a) after a statement of marital breakdown has been received by the court and before any application for a divorce order or for a separation order is made to the court by reference to that statement.
(b) when an application for a divorce order ro separation order has been made under section 3 of the 1996 Act and has not been withdrawn;
(c) when an application for a divorce order has been made following the cancellation of an order preventing divorce under section 4 of the 1996 Act and has not been withdrawn;
(d) when an application for a divorce order has been made following the cancellation of an order preventing divorce under section 10 of that Act and has not been withdrawn;
(e) after a divorce order has been made;
(f) when a separation order is in force.”
The effect of this is that order may be made at any time after a statement has been filed, provided it has not been withdrawn (which can only be done by consent), whether or not a divorce order or a separation order has been granted. However, certain restrictions as to time are imposed by s 22 B. The effect of these is as follows:
(1) Except for an interim periodical payments order, the court may not make a financial provision order during any period which has to be disregarded in determining the period for reflection and consideration fixed by s 7(8) of the Act (s22B82)); this refers to the provision whereby, if both parties notify the court that they are attempting a reconciliation and require more time, the period of reflection and consideration stops running until the court is notified that the attempted reconciliation has been unsuccessful.
(2) No financial provision order of any description may be made where, by virtue of s 5(3) or s 7(9) of the 1996 Act, it has ceased to be possible for an application for a divorce order or a separation order to be made by reference to the statement filed, or for such an order to be made more then one year has passed since the end of the period for reflection and consideration is extended beyond 18 months. In those circumstances, time has run out,, the statement ceases to have any effect, and the marital proceedings are, in effect, dead.
(3) Section 22B(4) deals, with the time when an application for financial provision must be made. The effect of the provision is that an application must be made before a divorce order or separation order is made, and, if not, can only be made with leave of the court.
Subject to the restrictions in s 22B, therefore, the court may make orders for financial provision or property adjustment at any time after a statement has been filed. The question of when such orders may take effect is a separate one, and is dealt with at para 6. 10
How many orders?
Section 22A(3) deals with the number of financial provision orders which the court may make. The court may make:
(a) a combined order against the parties on one occasion;
(b) separate orders on different occasions;
(c) different orders in favour of different children;
(d) different orders from time to time in favour of the same child”
However, the amended MCA 1973 follows the previous law in restricting the number of orders which may be made. Accordingly, subsection (3) concludes by providing that the court:
“may not make in favour of the same party more than one periodical payments order, or more than one order for payment of a lump sum….”
The effect of this is that, one an order for periodical payments (other than an interim order) has been made, it can only be altered by a variation order. As will be seen when variation is considered at para 6.17, a lump sum order cannot be varied, save where it is payable by instalments, and accordingly continues to be a “final order”.
The position as to the number or property adjustment orders which may be made is expressed differently, but is similar in effect. Section 23 A(1) provides that the court may, at the appropriate time (as defined above), “make one or more property adjustment orders”. However, this is qualified by s 23A(2), which provides that, when the court makes more than one property adjustment order, “each order must fall within a different paragraph of section 21(2)…”
In other words, the court may make and order that one party transfer a property to the other party, and, on the same or a later occasion, order settlement of property, or a variation of a settlement; having exercised its power to make one class of property adjustment order, it cannot do so again.
6.8 Section 23A(3) directs the court as to exercise of its jurisdiction, by providing that:
“he court shall exercise its powers under this section, so far as is practicable, by making on one occasion all such provision as can be made by way of one or more property adjustment orders in relation to the marriage as it thinks fit”.
This must be regarded as an overriding directive, and, taken with the other provisions set out above, the intention of legislation is clearly that orders of a capital nature should be treated as final orders. Whether that intention will be realised in practice remains to be seen, and the provision for “interim lump sums” considered at para 6.15 gives rise to some doubts in this respect.
Restrictions on periodical payments
6.9 Before the coming into force of the amendments affected by the 1996 Act, s 25A(3) of the MCA 1973 provided that, if the court considered that no continuing obligation should be imposed on either party to make or secure periodical payments in favour of the other party, the court might dismiss the application with a direction that the applicant should be not be entitled to make any further application .”
The express power to dismiss has, therefore, in effect been retained in this form.
For the sake of completeness in this context, mention must be made of ss 22B(4) and 23B(4), which apply respectively to financial provision orders and property adjustment orders; their effect is that once a divorce order has been made or a separation order is in force, no financial provision order nor property adjustment may be made except in relation to an application made before the divorce or separation orders or on a subsequent application with leave of the court. Clearly, finality is one of the aims of these provisions; it would only be in exceptional circumstances that an application for financial relief would only be allowed to survive the grant of a divorce or separation order, and one suspects that leave to make such an application after divorce or separation would be granted only sparingly.
When may orders take effect?
6.10 Under the pre-1996 law, no financial orders except orders of a temporary or interim nature, could be made until decree nisi, and they could not take effect until decree absolute (for an exception see Barry v Barry, discussed at para 6.13). The fact that any order may now be made at any time after the filing of the statement of marital breakdown, coupled with the fact that there is now to be on divorce order, with no delay between orders nisi and absolute, has meant that the Act has to provide for the problem of when the order should take effect.
This raised issues of principle for the draftsman of the legislation. On the one hand, in could be, and was, argued that since the purpose of the period for reflection and consideration was to allow parties to investigate the possibility of reconciliation, this purpose might be frustrated if the parties were permitted to rush into litigation and if the court made orders which could be implemented and which might have an irreversible effect. On the other hand, practitioners in this field submitted that long delays between the making of an order and its taking effect could have unfortunate consequences, and would impose an artificial stalemate.
6.11 In respect of property adjustments orders, the solution is contained in s 23B. This provides that no property adjustment order may be made so as to take effect before the making of a divorce order or a separation order unless the court is satisfied:
“(a) that the circumstances of the case are exceptional; and
(b) that it would be just and reasonable for the order to be made.”
Clearly, (b) presents few difficulties; the court would have to decide whether, in effect, it was fair to grant the leave sought, bearing in mind the interests of both parties.
However, (a) is more difficult. The starting point for the court would have to be the general prohibition on allowing orders to take effect before a divorce or separation order. It would then have to decide whether the circumstances of the instant case were exceptional; given that every case turns on its own facts, the court would have to decide how exceptional, or far from the norm, a particular case was before it would qualify for this description.
In relation to consent orders parties will, of course, bear in mind that there will be nothing to prevent them from implementing whatever arrangements they have agreed. Presumably, orders made in such cases would contain a lengthy preamble, consisting of undertakings, or recitals of what had already been done, and the order would be confined to dismissals of all claims.
6.12 The position as to lumo sum orders is exactly the same, s22B(4) being in identical terms, mutatis mutandis, with s 23B(4).
Interim orders
6.13 Under the pre-1996 law, the court had power to make various interim orders. In respect of periodical income orders, it could make orders for maintenance pending suit before decree absolute, and interim periodical payments thereafter. The position as to orders of a capital nature was more limited. Section 23(3) of the Act permitted the court to order payment of a lump sum for the purpose of enabling the recipient to meet liabilities or expenses reasonably incurred. This was expressed to be without prejudice to the court’s general power to make a lump sum order. There was no statutory power to make an interim order for sale nor a property adjustment order. However, it was decided in Barry v Barry [1992] 2 FLR 233 that the court had an administrative power of appropriation which it could exercise before decree, by, for example, ordering the sale of a property and the payment of all or part of the proceeds to one party, provided the funds were sufficient to be taken into account at the final hearing.
6.14 The position is now somewhat different. First, the terms “maintenance pending suit” has had to disappear because of the new terminology. As was seen above, any financial provision order can be made at any time after the filing of the statement of marital breakdown. Section 22A(4) now provides that:
“If it would not otherwise be in a position to make a financial provision order in favour of a party or child of the family, the court may take an interim periodical payments order, an interim order for the payment of a lump sum, or a series of such orders, in favour of that party or child.”
The court therefore has power to make interim periodical payments in cases where it is not yet possible to deal with the matter on a final basis. (However, it may not do so before the statement has been made and filed because only then do proceedings start.)
6.15 As has seen, s 22A(4) also deals with interim lump sum orders, and here the intention seems to be, in effect, to repeat the old s 23(3). The provision for interim lump sum orders is an innovation. As mentioned above, there was provision, under the old s 22(3), for interim lump sum orders to meet urgent expenses; these were expressly to be taken into account as and when the court made a final lump order.
Here, there is no guidance to the court as to the circumstances in which it should make an interim lump sum order, nor is there any provision that such an order is without prejudice to the final order or that it must be taken into account on the making of the final order.
6.16 There is no express provision for interim property adjustment orders. The position is explained at para 6.6 and 6.10.
Variation orders
6.17 As before, it is only intended in this section to draw attention to those parts of ss 31 to 33 which have been changed by the 1996 Act. However, these changes are considerable. In addition to the changes which are necessary to give effect to the 1996 Act, it seems that the opportunity to make certain other changes has been taken. The changes may be summarised as follows:
(a) changes to give effect to new nomenclature;
(b) provisions as to when variation orders may take effect
(c) new powers for the court when discharging periodical payments orders;
(d) provisions to govern the position where the parties are reconciled.
6.18 The first matter to be considered is that of which types of orders may now varied. The list is contained in s 31(2), and, although the terminology is in some cases now different (eg maintenance pending suit has been deleted), the types of orders which may be varied have not been substantially changed. It should be noted that subsection (2)(dd) refers to deferred orders made under s 21(1)(c); this is a reference to de ferred lump sum orders relating to pensions, and this provision was inserted by the Pensions Act 1995. Pensions, generally, are discussed at para 6.28.
6.19 Subsection (4B) deals with the question of when a variation order may take effect. It provides that:
“no variation-
(a) of a financial provision order made under section 22A above, other than an interim order, or
(b) of a property adjustment order made under section 23A above, shall be made so as to take effect before the making of a divorce order or separation order in relation to the marriage, unless the court is satisfied that the circumstances of the case are exceptional, and that it would be just and reasonable for the variation to be so made.”
The wording repeats ss 22B(1) and 23B(1).
6.20 By subsection (7A), subsection (7B) applies:
“where after the dissolution of a marriage, the court-
(a) discharges a periodical payments order or secured periodical payments orders made in favour of a party to the marriage, or
(b) varies such an order so that payments under the order are required to be made or secured only for such further period as is determined by the court.”
The situation envisaged is, therefore, that there has been a periodical payments order which the court considers it appropriate to discharge or to limit to a finite period; in other words, the court imposes a clean break. Before this enactment, the position was that which was found in S v S [1987] 1 FLR 71, where the court thought it right to discharge a periodical payments order which had been in favour of the former wife of a successful popular entertainer upon his undertaking to pay her a lump sum, but held that, in the absence of such en undertaking, it would not be able to order yhe lump sum; there is, in fact, no reported case in which such an undertaking has been excepted as being adequate (see eg Boylan v Boyland [1991] 1 FLR 282).
These subsections are designed to remedy that lacuna, and follow a recommendation of the Law Commission (Law Com 192 paras 6.8-6.10). It may be noted that the Act provides no guidelines to assist the court in making a decision in such a case. It is possible that such an application would be made, say, 20 years after the periodical payments order had been made, at which stage court, presumably, would have to rehease the issues between the parties de novo, and, in more substantial cases, consider updated Duxbury calculations.
6.21 Subsection (7B) provides that the court has power, in addition to any other power it may have, to make supplemental provision consisting of:
“(a) an order for payment of a lump sum in favour of a party to the marriage;
(b) one or more property adjustment orders in favour of a party to the marriage;
(c) a direction that the party in whose favour the original order discharged or varied was made is not entitled to make any further application for-
(i) a periodical payments or secured periodical payments order, or
(ii) an extension of the period to which the original order is limited by any variation made by the court.”
The court now has, therefore, power to order either a lump sum or a property adjustment order, or both, as “compensation” for the loss of periodical payments.
The effect of subsections (7C) to (7F) is that the same restrictions as apply to financial provision orders and property adjustment orders, for example requiring the court to make only one property adjustment order of each class in s 21(2), apply to orders made on variation. By subsection (7C), any lump sum order made on variation may be ordered to be paid by instalments.
6.22 The provisions of s 31 are required because of the power of the court to make financial provision orders and property adjustment orders before a divorce order has been made; some provision had to be made to deal with the position where, for some reason, the divorce did not proceed.
It might have been thought that some provision would be made for the situation where, a property adjustment order or financial provision order having been made, and having taken effect, no divorce order is then granted. However, this is not the case, and, in the circumstances just described, the only remedy of an aggrieved spouse would be to apply to set aside the order or to seek leave to appeal out of time.
Section 31 A is confined to the situation where parties are agreed that an order should be discharged and, in some cases, it is a condition that they have been reconciled before a divorce order is granted. As such, it will be of very limited practical effect, since, it may be thought, if the parties are sufficiently ad idem to make a joint application to set aside an order, very little turns on the outcome of the application. (The provision seems to be designed for those who do not really need it.)
6.23 Section 31A(1) provides that where, at any time before the making of a divorce order:
“(a) an order (“a paragraph (a) order”) for the payment of a lump sum has been made under section 22A above in favour of a party;
(b) such an order has been made in favour of a child of the family but the payment has not yet been made, or;
(c) a property adjustment order (“a paragraph (c) order”) has been made under section 23A above.
The court may, on an application made jointly by the parties to the marriage, vary or discharge the order.”
The court therefore has discretion to make the order as sought, or any other order, but the provision is limited to joint consensual applications.
6.24 When an order is made under s 31A(1), it is not essencial that the parties have been reconciled, although, no doubt, this will frequently be the case. However, subsections (2), (3) and (4) confer additional powers on the court, and it is provided by subsection (6) that the court may not make such orders unless it appears to it that there has been a reconciliation between the parties to the marriage.
Subsection (2) provides that where the court varies or discharges a paragraph (a) order (ie a lump sum order) it may order the repayment of an amount equal to the whole or any part of the lump sum. The only comment to take on this is that, given that the parties are reconciled and are making a joint application, one wonders why this provision is thought to be necessary and whom it is designed to help.
6.25 Subsection (3) deals with the position where the court varies or discharges a paragraph (c) order (ie a property adjustment order), and the order has taken effect. Here, the court may:
(a) order any person to whom property was transferred in pursuance of the paragraph (c) order to transfer-
(i) the whole or any part of that property, or
(ii) the whole or any part of any property appearing to the court to represent that property,
in favour of a party to the marriage or a child of the family; or
(b) vary any settlement to which the order relates in favour of any person or extinguish or reduce any person’s interest under that settlement.”
Subsection (4) is a linked provision, since it provides that, where the court acts under subsection (3), it may:
“make such supplemental provision (including a further property adjustment order or an order for the payment of a lump sum) as it thinks appropriate in consequence of any transfer, variation, extinguishment, or reduction to be made under paragraph (a) or (b) of that subsection.”
6.26 Once again, it is difficult to conceive of circumstances in which these provisions will be invoked. The subsection can only come into effect when the court is satisfied that the parties have been reconciled, and on joint application. Even conceding that there may be cases where such reunited couples think it prudent to undo the legal requirements which have previously been imposed on them, one might think that there would be a degree of overkill in making new property adjustment orders to reflect the process of adjustment which they have agreed.
6.27 Finally, subsection (7) provides that the court shall not make an order under subsection (3) or (4) above unless it appears to it that the order will not prejudice the interests of any child of the family or any person who has acquired any right or interest in consequence of the property adjustment order and is not a party to the marriage or a child of the family.
Pensions
6.28 Provisions of the Pensions Act 1995 intended to give the court power to “earmark” pensions payments for benefit of a divorced spouse were brought into force in respect of petitions filed on or after 1 July 1996: see para 5.14 above; but, in the course of the Parliamentary debates on the Family Law Bill, the Government came under renewed pressure to introduce effective measures whereby the parties” expectations under pension schemes could be re-allocated on divorce. The Government was defeated on a division (see Official Report (HL) 29 February 1996) and an amendment was made to the Bill.
However, as the Minister of State in the Department of Social Security put it, this amendment “expressed the principle but did not will the means to put it into practice”; and in the House of Commons further provision (now to be found in s 16 of the Act) was made in an attempt to will the means, albeit in the absence of a full policy on many important matters, by giving the Lord Chancellor extensive powers to make regulations, extending even to the power to amend primary legislation. The Minister of State made it clear that this was an unsatisfactory procedure, and that further primary legislation would be required (see Official Report (HL) 27 June 1996, col 1090).
The position is, therefore, that the Government has started that it is “fully committed to the principle of pension splitting”, in July 1996, the Government published a Consultation Paper The Treatment of Pension Rights on Divorce (CM 3345) seeking views on a wide range of issues. It is intended in due course to publish a White Paper containing a full package of policy proposals, “followed by legislation as soon as it is practicable” (ibid). The principle of pension splitting has been preserved on the face of the Bill; but it seems certain that the provisions which will ultimately govern this complex matter will be different from those of s 16. In the circumstances, it is not proposed to comment on the details of the section (which appears quite inadequate to achieve the objectives of its promoters).
Conduct
6.29 Before the coming into force of the Act, the approach of the courts to the relevance of the conduct of the parties in relation to financial relief was well settled, and conduct was only an issue in the comparatively rare cases in which it would be inequitable to disregard it. It is possible that this attitude may have to change, because of an amendment to s 25 of the MCA 1973 effected by the Act.
In the course of the debates on the 1996 Act, it became clear that there was a perception among some MPs that conduct was not accorded the prominence by the courts which they considered it should have. The Parliamentary Secretary to the Lord Chancellor’s Department stated that “anecdotal evidence” suggested that “if conduct was taken into account” only conduct of a financial nature was normally considered (Official Report (HC) 16 May 1996, col 371). Ministers had earlier successfully resisted attempts to highlight conduct, but in the House of Commons on Second Reading the Minister was eventually driven to concede that the court’s practice did not satisfy everyone, and that conduct was “extremely important” (Official Report (HC) 25 March 1996 col 738).
Accordingly, the Government brought forward an amendment to s 25 (g), adding, after “parties”, the words:
“whatever the nature of the conduct and whether it occurred during the marriage or after the separation of the parties or (as the case may be) dissolution or annulment of the marriage.”
In moving this amendment, the Parliamentary Secretary said that the purpose of the amendment was:
“to emphasise that conduct of the parties of whatever nature, should it be inequitable to disregard it, has to be taken into account and that it is not only conduct in the course of ancillary relief proceedings that has to be considered.” (Mr Jonathan Evans, Standing Committee E, Official Report (HC) 16 May 1996, col 371).
It is difficult to predict the likely impact of this amendment on the approach of the courts. On the one hand, it may be said that the amendment was designed to clarify, rather than change, the law. On the other hand, it may be presumed that Parliament must have intended to change the law in some respects. It seems certain that litigants will be encouraged by these amendments to persist in making allegations of conduct in circumstances in which they would formerly have been advised that to do so would be pointless.
Procedure
6.30 There is nothing in the 1996 Act to govern procedure as such, and this will be subject of amendments to the FPR 1991. Nevertheless, it is possible to speculate as to what the changes are likely to be.
There is no prohibition on the issuing of an application for financial relief at any stage; indeed, the fact that all proceedings have to have been completed within the period for reflection and consideration, which may be as little as nine months, will be an encouragement to parties to proceed with their litigation promptly. There are provisions which only allow the making of an application after the making of a divorce order with leave of the court, but they are designed to ensure that there is some finality, and that parties do not present a spurious agreement to secure their divorce and then seek to litigate later. The emphasis is, therefore, on getting proceedings under way and completing them within the period.
6.31 Proceedings for financial relief may only be instituted when the marital proceedings exist, which is after the statement has been filed. The statement cannot be filed until three months after the information meeting, which leaves a potential gap for those applicants who are in need of urgent financial relief. Such an applicant will have to apply to a magistrates’ court, or to the county court under s 27 of the MCA 1973. As to the latter remedy, s 27 has been amended by Sch 8 to the 1996 Act, to provide that, on an application under that section, the court may make “one or more financial provision orders against the respondent in favour of the applicant or a child of the family”. (The reference to “child of the family” must, of course, be read subject to s 8 of the Child Support Act 1991.)
6.32 Subject to what has been said, there is little to add about procedure; on the face of it, this will be the same as under the 1973 Act. However, it may well be that procedure in financial relief cases will be changed as a “result of a pilot project initiated by the Lord Chancellor on the advice of his Advisory Group on Ancillary Relief, and governed by a Practice Direction dated 25 July 1996. It may be that recommendations arising out of these pilots will have been made by the time the Act comes into force.
CHAPTER SEVEN
CHILDREN IN THE DIVORCE PROCESS
INTRODUCTION
7.1 The Family Law Act 1996 is not primarily concerned with the law relating to children; but anxieties about the impact of marital breakdown on children were voiced both by the Law Commission and in the Government’s 1995 White Paper. In the course of the debates on the Bill for the Family Law Act amendments were made which are intended to minimise the damage done to children by the divorce process. Although the main provisions relating to children involved in marital breakdown are still to be found in the Child Support Act 1991 and in the Children Act 1989, it may be helpful to bring together in this chapter the provisions of the 1996 Act which have particular relevance to children.
The interrelationship of the Children Act 1989 and the Family Law Act 1996: procedures available for resolving questions about the welfare of children
7.2 Paragraph 60 of Sch 8 to the 1996 Act amends the Children Act 1989, s 8(4), so that proceedings under the 1996 Act constitute “family proceedings” for the purposes of that Act ; and the Children Act 1989 is also amended so that for the purposes of any reference in that Act to “family proceedings” powers which under the Children Act 1989 are exercisable in family proceedings are also exercisable in relation to a child, without any such proceedings having been commenced or any application having been made to the court under the Children Act if: (a) a statement of marital breakdown under s 5 of the 1996 Act (as to which see para 2.11) with respect to the marriage in relation to which that child is a child of the family has been received by the court; and (b) it may, in due course, become possible for an application for a divorce order or for a separation order to be made by reference to that statement (Children Act 1989, s 8 (5) as inserted by the Family Law Act 1996, Sch 8, para 41(4)). (In this, and other provisions of the Act, “child of the family” has the same meaning as in the Matrimonial Causes Act 1973, s 52 (see Hershman and Macfarlane, Children Law and Practice, (Family Law) para D[637]).)
Translation - Catalan Compensació econòmica en casos de divorci i separació
Introducció
6.1 Les parts generals de la Llei de 1996 que afecten la compensació auxiliar de la Llei de 1996 s’exposena l’article 15(2). Aquest estableix que:
“l’objecte principal de l’Anex 2 [que esmena aquesta part de la Llei de Causes Matrimonials de 1973 en que es resol la compensació econòmica] és:
(a) establir que, en els casos de divorci i separació, es pot dictar, davent d’aquesta Llei, una sentència de compensació econòmica abans de que es presenti una sentència de divorci o separació;
(b) mantenir (amb canvis de poca importància) la posició d’aquesta Llei en que s’anul•len els matrimonis.
L’article 15(3) continua dient que l’Anex 2 també presenta esmenes de la Llei de 1973 de poca importància però conseqüents lligats als canvis mencionats a l’apartat 1.
En realitat, els canvis efectuats per la Llei són més extensos del que pot semblar en comparació als objectes mencionats a l’a. 15(2), i s’han d’examinar detalladament. Els canvis en relació a les pensions s’analitzen al para 6.28.

6.2 El primer dels canvis parla dels acords pel futur. Un dels principis escencials de la Llei diu que les parts haurien d’haver resolt els acords econòmics i altres acords durant el període de reflexió i consideració, i tal com hem vist al Capítol Quatre, que un sol•licitant d’una sentència de divorci ha de dictar un auto o un conveni regulador que tracti els assumptes econòmics, o ha de satisfer el tribunal de que no és factible. La veritat és que s’ha de dictar qualsevol sentència excepte si el sol•licitant entra en alguna de les excepcions de la norma.
6.3 Les “esmenes de poca importància però conseqüents” que fan referència a l’apartat 3 resolen les sentències que pot dictar el tribunal, i quan haurien d’entrar en vigor. A la Llei prèvia a la de 1996, era necessari tenir una sentència de divorci condicional abans de que es pugui dictar una sentència de capital natural, i una sentència definitiva abans de que pugui entrar en vigor.
Hi ha disposicions a la llei que resolen les pensions i que aquestes s’hauran de considerar. Finalment, s’han d’analitzar els canvis potencialment importants pel que fa a la conducta de les parts.
6.4 Per tant, els problemes que es resolen en aquesta capítol són el següents:
(a) sentències que pot presentar el tribunal;
(b) quan es poden dictar les sentències i quan poden entrar en vigor.
(c) Les noves disposicions pel que a les modificacions.
(d) Les noves diposicions pel que fa a les pensions

(f) Procediment
S’ha de remarcar que aquest no és un text comprensiu sobre la compensació econòmica; els problemes que es tracten a aquest capítol només van relacionats als canvis que es van fer amb la Llei de 1996, i els problemes estretament associats a aquests canvis. Les referències a la Llei de 1973 són, naturalment, referències a la Llei segons es va esmenar per la Llei de 1996.
Sentències que pot dictar el tribunal.
6.5 L’article 21 de la Llei de Causes Matrimonials de 1973 ara estableix dues classes de sentències de compensació econòmica: les sentències de pensió compensatòria i les sentències que disposen la conclusió i liquidació de la societat de guanys.
Les “sentències de pensió compensatòria” consten del següent:
(a) sentències de pagaments periòdics
(b) sentències de pagaments periòdics garantitzats;
(c) sentències de pagaments d’una quantitat global (sentència de quantitat global).
Les “sentències que disposen la conclusió i liquidació de la societat de guanys” consten de:
(a) una sentència per cedir els béns a l’altra part o un fill o filla
(b) Una sentència per al conveni de béns;
(c) Una sentència per a la modificació del conveni
(d) Una sentència que extingueixi o redueixi un interès d’un conveni.
Això no canvia la substància de la Llei prèvia. No obstant, hi ha canvis en detall.
Quan es poden dictar les sentències?
6.6 Qualsevol d’aquestes sentències es pot dictar al “moment apropiat” (LlCM 1973, a22A(1) i a 23A(1)). A l’article 22A(2) es defineix el moment apropiat com a qualsevol moment:
(a) després de que el tribunal hagi rebut la declaració de ruptura matrimonial i abans de que es cursi cap sol•licitut de sentència de divorci o separació en referència a aquesta declaració.
(b) En que s’ha cursat una sol•licitut de sentència de divorci o sentència de separació davant l’article 3 de la Llei de 1996 i no s’ha anul•lat.
(c) En que s’ha cursat una sol•licitut de sentència de divorci davant l’article 4 de la Llei de 1996 i no s’ha anul•lat.
(d) En que s’ha cursat davant l’article 10 d’aquesta llei, una sol•licitut de sentència de divorci seguida de l’anul•lació d’una sentència per impedir el divorci i no s’ha anul•lat.
(e) Després de que s’ha presentat una sentència de divorci.
(f) En que una sentència de separació és vigent.
El resultat és que es pot dictar una sentència en qualsevol moment després de que s’ha presentat la declaració (que només es pot fer per consentiment), tant si s’ha acceptat com si no una sentència de divorci o una sentència de separació. No obstant, l’article 22B imposa certes restriccions pel que fa al moment.
El resultat és el següent:
(1) Excepte la sentència cautelar de pagaments periòdics, el tribunal no pot dictar cap sentència de pensió compensatòria durant qualsevol període que s’ha de tenir en compte a l’hora de determinar el període de reflexió i consideració fixat per l’a 7(8) de la Llei de 1996 (a 22B(2)); aquest es refereix a la disposició per la qual, ambdues parts notifiquen el tribunal que intenten una reconciliació i necessiten més temps, el temps del període de reflexió i consideració es deté fins que es notifica el tribunal de que l’intent de reconciliació no ha tingut èxit.

En aquestes circumstàncies, el temps s’ha esgotat, la declaració deixa de tenir cap efecte, i els procediments matrimonials queden, com a conseqüència, morts.
(3) L’article 22B (4) resol, com a conseqüència, el moment en que s’ha de cursar la sol•licitut de la pensió compensatòria. El resultat de la disposició és que s’ha de cursar la sol•licitut abans que es dicti la sentència de divorci o la sentència de separació, i si no, només es pot fer amb la vènia del tribunal.
Per tant, subjecte a les restriccions de l’a 22B, el tribunal pot dictar sentències per a la pensió compensatòria o sentències que disposen la conclusió o liquidació de la societat de guanys en qualsevol moment després de que es presenti la declaració. La qüestió sobre quan poden entrar en vigor les sentències, va a part, i es resol al para 6.10.
Quantes sentències?
6.7 L’article 22A(3) resol el nombre de sentències per a la pensió compensatòria que pot dictar el tribunal. El jutjat pot dictar:
(a) una sentència combinada contra les parts, en una sola ocasió.
(b) Sentències separades en vàries ocasions
(c) Diferents sentències a favor de fills diferents
(d) Sentències diferents en moments diferents a favor del mateix fill.
No obstant, la LCM esmenada de 1973 segueix la llei prèvia a l’hora de restringir el nombre de sentències que pot dictar al tribunal. Com a conseqüència, la (3) conclou quan disposa que el tribunal:
“no pot dictar més d’una sentència de pagaments periòdics o més d’una sentència de pagament d’una quantitat global a favor de la mateixa persona.
El resultat d’aquesta és que, un cop s’ha presentat una sentència de pagaments períodics (other than a sentència cautelar), només la pot alterar una sentència de modificació. Tal com veurem al para 6.17 quan es considera la modificació, no es pot variar una sentència de pagament de la quantitat global, excepte si es pot pagar a terminis, i com a resultat passa a ser una “sentència definitiva”.
La situació pel que fa al nombre de sentències que disposen la societat de guanys, s’autoritza de forma diferent, però és similar en el resultat. L’article 23 A (1) disposa que el tribunal pot, en el moment apropiat (definit anteriorment), “dictar una o més sentències de societat de guanys”. No obstant, l’article 23 A (2) l’autoritza, i disposa que, quan el tribunal presenti una o més sentències de societat de guanys, “cada sentència ha d’entrar un paràgraf diferent de l’article 21(2)...”.
En altres paraules, el tribunal pot presenatr una sentència que digui que una part cedeix la societat a l’altra part, i en la mateixa o darrera ocasió, una sentència per a l’acord de la societat de guanys, o modificació de l’acord; quan s’ha exercit el poder de dictar una sentència per a la conclusió i liquidació de la propietat de guanys, no es pot tornar a fer.
Quan poden entrar en vigor les sentències?
6.10 A la llei prèvia a la de 1996, no es podien fer les sentències econòmiques, excepte sentències de natural temporal o cautelar, fins la decisió de divorci condicional, i no podien entrar en vigor fins la sentència definitiva (per veure’n una excepció veien Barry contra Barry, tractat al para 6.13). El fet de que ara es pot fer qualsevol sentència en qualsevol moment abans d’omplir la declaració de ruptura matrimonial, unida al fet de que hi ha d’haver una sentència de divorci, sense cap espera entre la sentència provisional i la definitiva, vol dir que la llei ha d’establir el problema sobre quan ha d’entrar en vigor la sentència. Això va plantejar problemes de principis al redactor de la legislació. Per una banda, es pot, i es va discutir que el propòsit del període de reflexió i consideració fos permetre a les parts investigar la possibilitat de reconciliació, aquest propòsit pot no tenir èxit si es permetés a les dues parts fer la litigació precipitadament i si el tribunal presentés sentències que es poguessin portar a terme i que poguessin tenir un efecte irreversible. Per altra banda, els professionals d’aquest camp van suggerir que les llargues esperes entre que es presenta una sentència i aquesta entra en vigor podrien tenir unes conseqüències desafortunades, i imposarien una paralització artificial.
6.11 L’article 23B conté la solució respecte a les sentències que disposen la conclusió i liquidació de la societat de guanys. Aquesta disposa que no es pot dictar ni entrar en vigor cap sentència que disposi la conclusió i liquidació de la societat de guanys abans de que es presenti una sentència de divorci o separació, excepte si es convenç el trubunal de:
(a) que les circumstàncies del cas són excepcionals; i
(b) que seria just i raonable dictar la sentència”.
Clarament, la (b) presenta menys dificultats; el tribunal hauria de decidir si, en efectem seria just concedir el consentiment demanat, i tenir en compte els interessos de les dues parts. No obstant l’(a) és més difícil. El punt de sortida pel tribunal hauria de ser una prohibició general a l’hora de permetre que les sentències entrin en vigor abans que una sentència de divorci o separació. Llavors s’hauria de decidir si les circumstàncies del cas actual eren excepcionals; donat que cada cas ataca els seus propis fets, el tribunal hauria de decidir com era d’excepcional o com sortia del normal, un cas particular abans de que es qualifiqués per a aquesta descripció.
En relació a les ordres de consentiment les parts hauran, naturalment, de tenir en compte que ho hi haurà res per prevenir-les a l’hora de complir qualsevol dels acords als que han arribat. És de suposar que, les ordres presentades en aquests casos contindrien un extens preàmbul que consistiria en empreses, o parts expositives d’escriptures del que ja s’ha fet, i la ordre estaria restringida a les desestimacions de totes les reclamacions.
6.12 La situació pel que fa a les sentències per a una quantitat global és exactament la mateixa, l’art 22B (4) té els termes idèntics que l’art 23 B (4), canviant el que s’hagi de canviar.
Sentències cautelars
6.13 A la llei prèvia a la de 1996, el tribunal tenia el poder de dictar vàries sentències cautelars. Respecte a les ordres d’ingressos periòdics, es podien dictar ordres de pensió alimentària durant un procès pendent abans de la sentència de divorci definitiva, i els pagaments periòdics cautelars a continuació. La situació pel que fa a les sentències d’un naturak capital era més limitada. L’article 23 (3) de la Llei permetia al tribunal d’ordenar el pagament d’una quantital global pel propòsit de permetre al receptor afrontar les responsabilitats o les despeses que ha tingut de forma raonable. Aquest es va formular sense prejudici al poder general del tribunal per fer una sentència de quantitat global. No hi havia poder legislatiu per dictar una ordre cautelar per vendre ni una sentència que disposés la conclusió i liquidació de la societat de guanys. No obstant, al cas Barry contra barry [1992] 2 FLR 233 es va decidir que el tribunal tenia el poder administratiu per a l’apropiació que podia exercir abans d’una sentència, per exemple, a l’hora d’ordenar la venta d’una propietat i el pagament de tots els procediments o part d’ells a una de les parts, i establert que els fons eren suficients per tenir en compte a la vista final.
6.14 la situació actualment és una mica diferent. En primer lloc, el terme “pensió alimentaria durant un procès pendent” ha hagut de desaparèixer degut a la nova terminologia. Tal com hem vist abans, es pot dictar qualsevol sentència de pensió compensatòria en qualsevol moment després de que s’hagi omplert la declaració de ruptura matrimonial. L’article 22A (4) estableix que:
“Si per contra no està en situació de dictar una sentència de pensió compensatòria a favor d’una de les parts o del fill, el tribunal pot dictar una sentència cautelar de pagaments periòdics, una sentència cautelar d’una quantitat global o una sèrie d’aquestes sentències, a favor d’aquesta part o fill.
Per tant, el tribunal té poder per dictar sentències cautelars de pagaments periodics en casos en els que encara no ha estat possible solucionar la qüestió en un fonament final. (No obstant, no es pot fer abans de que s’hagi omplert i presentat la declaració perqué a partir de llavors és quan es duen a terme els procediments).
6.15 Tal com hem vist, l’art 22A (4) també relon les sentències cautelars d’una quantitat global, i aquí la intenció sembla ser, en efecte, la de repetir l’anterior 23(3). La disposició per a les sentències cautelars d’una suma global és una innovació. Com hem mencionat anteriorment, hi havia una disposició, a l’antic art 22(3), per les sentències cautelars d’una quantitat global perqué afrontessin les despeses urgents; aquesta s’havia de tenir especialment en compte a mesura que el tribunal presentava una sentència d’indemnització final.
Aquí, no hi ha cap orientació al tribunal pel que fa a les circumstancies en que s’haurien de dictar una sentència cautelar d’una suma global, ni tampoc hi ha cap disposició de que una sentència és sense perjudici a la sentència final o que s’ha de tenir en compte a l’hora de dictar la sentència final.
6.16 No hi ha cap disposició expressa per les sentències que disposen la conclusió i liquidació de la societat de guanys. S’explica la situació als para 6.6 i 6.10.
Ordres de modificació
6.17 Tal com hem vist abans, en aquest article només s’intenta posar atenció a aquelles parts dels articles 31 al 33 que la llei de 1996 ha canviat. No obstant, aquests canvis són considerables. A més dels canvis que és necessari que entrin en vigor amb la llei de 1996, sembla que s’ha agafat la oportunitat de fer altres canvis. Els canvis es resumeixen en el següent:
a) canvis per entrar en vigor a la nova nomenclatura
b) disposicions sobre quan han d’entrer en vigor les sentències de modificació
c) nous poders pel tribunal quan es satisfaguin les sentències de pagaments períodics;
d) disposicions per dirigir la situació en que les parts es reconcilien.
6.18 La primera qüestió que s’ha de considerar és la de quins tipus de sentències es poden modificar. Trobareu la llista a l’art 31(2), i, tot i que la terminologia en alguna casos actualment és diferent (ex. La pensió alimentaria en un procès pendent s’ha eliminat), els tipus de sentències que es poden modificar no s’han canviat substancialment. Hauriem de fixar-nos en que l’apartat (2) (dd) es refereix a les sentències aplaçades d’una quantitat global pel que fa a les pensions, i es va insertar aquesta disposició a la Llei sobre les Pensions de 1995. Es tracten les pensions, normalment, al para 6.28.
6.19 El subarticle (4B) relon la qüestió de quan pot entrar en vigor una sentència de modificació. Estableix que:
“No es pot fer cap modificació
(a) d’una sentència de pensió compensatòria a l’article 22A above, ni cap sentència cautelar, o
(b) no s’hauria de presentar ni entrar en vigor cap modificació d’una sentència que disposi la conclusió i liquidació de la societat de guanys a l’article 23A above abans de dictar una sentència de divorci o separació en relació al matrimoni, excepte si es satisfà al tribunal de que les circumstàncies del cas són excepcionals, i que seria just i raonable de que es fes la modificació.
La redacció repeterix els art 22B (1) i 23 B (1).
6.20 Es sol•licita per les subseccions (7A) i (7B): “que, després de la dissolució d’un matrimoni, el tribunal
(a) satisfà una sentència de pagaments periòdics asseguarada a favor d’una de les parts del matrimoni, o
(b) modifica aquesta sentència fent que s’exigeixi que es compleixin o s’assegurin els pagaments a la sentència només per un període posterior tal com ha determinat el tribunal”.
La situació que ens podem imaginar és, per tant, que hi ha hagut una sentència de pagaments períodics que el tribunal considera que s’ha de satisfer o limitar a un període finit; en altres paraules, el tribunal imposa una pausa neta. Abans d’aquesta promulgació, la situació era el que es va trobar a S contra S [1987] 1 FLR 71, en que el tribunal va considerar correcte satisfer una sentència de pagaments periòdics que s’havia presentat a favor de l’ex dona d’un popular i exitòs presentador a més a més d’assumir a pagar-li una quantitat global, però va mantenir que, amb l’absencia de tal undertaking, no era possible ordenar la quantitat global; no hi ha, de fet, cap cas presentat que s’hagi acceptat com a adequat (vegin ex Boylan contra Boylan [1991] 1 FLR 282).
Aquestes subseccions estan destinades a omplir aquest buit, i seguir una recomanació de la Comissió Legal (Law Com 192 para 6.8-6.10). Ens podem fixar en que la llei no estableix cap otientació per ajudar el tribunal a l’hora de pendre una decisió en un cas com aquest. És possible que una sol•licitut així es presentés, diu, 20 anys després de que es presentés la sentència de pagaments periòdics, at wich stage el tribunal, se suposa
6.21 L’apartat (713) estableix que el tribunal té poder, a més de qualsevol altre poder que pugui tenir, d’exposar disposicions suplementàries que consisteixen en:
(a) una sentència de pagament s’una quantitat global a favor d’una de les parts del matrimoni;
(b) una o més sentències que disposin la conclusió i liquidació de la societat de guanys a favor d’una de les parts del matrimoni;
(c) una direcció de que la part a favor de la qual s’ha satisfet o modificat la sentència original que es va dictar no té dret de sol•licitar cap més
(i) una sentència de pagaments periòdics o una sentència de pagaments periòdics assegurada, o
(ii) una extensió del periòde el qual la ordre original està limitat pe qualsevol modificació feta pel tribunal”.
El tribunal actualment té el poder, per tant, d’ordenar tant una sentència per a una quantitat global o una sentència que disposi la conclusió i liquidació de la societat de guanys, o ambdues, com a “compensació” per la pèrdua dels pagaments periòdics.
L’efecte de les subseccions (7C) a (7F) és que es poden aplicar les mateixes restriccions a les sentències de pensió compensatòria i les sentències que disposen la conclusió i liquidació de la societat de guanys, per exemple requerir al tribual que fagi només una sentència que disposi la conclusió i liquidació de la societat de guanys de cada classe a l’art 21(22), aplicar a les sentències presentades amb modificacions. A l’apartat (7C) no es pot ordenar que es pagui per plaços una sentència de quantitat global presentada amb modificacions.
6.22 Es requereixen les disposicions de l’article 31A degut al poder del tribunal per dictar sentències de pensió compensatòria i sentències que disposen la conclusió i liquidació de la societat de guanys abans de que es presenti la sentència de divorci; s’ha hagut d’exposar alguna sisposició per deal with la situació en que, per alguna raó, el divorci no procedia.
Es pot haver pensat que es fes alguna disposició per la situaci´en que s’hagi presentat una sentència que disposa la conclusió i liquidació de la societat de guanys o una sentència per a pensió compensatòria, i hagin entrat en vigor, llavors no es concedeix la sentència de divorci. No obstant, aquest no és el cas, i, en les circumstàncies ja descrites, l’únic remei per al cònjuge agreujat seria el de sol•licitar per deixar sense efecte o intentar poder apel•lar fora de termini.
L’article 31A està limitada a la situació en que les parts han acordat que s’ha d’anular la sentència i, en alguns casos, hi ha la circumstància que s’han reconciliat abans de que s’hagi concedit la sentència de divorci. Com aquest, tindrà un efecte pràctic limitat, desde llavors, es pot pensar, que si les parts són prou ad idem similars per fer una sol•licitut conjunta per anul•lar una sentència, poca cosa pot posar en marxa el resultat de la sol•licitut. (La disposició sembla que l’han dissenyat per aquells qui realment no la necessiten).
6.23 l’Article 31A(1) estableix que en qualsevol moment abans de que es presenti una sentència de divorci:
(a) s’ha de dictar una sentència (“una sentència del paragraf (a) pel pagament d’una quantitat global a l’article 22A above a favor d’una de les parts.
(b) S’ha de dictar una sentència que disposa la conclusió i liquidació de la societat de guanys a l’article 23A above,
El tribunal pot modificar o anul•lat la sentència si s’ha fet la sol•licitut conjuntament entre les parts.”
Per tan, el tribunal té la discressió de dictar una sentència as sought, o qualsevol altra sentència, però la disposició està limitada a les sol•licituts consençuals conjuntes.
6.24 Quan es presenta una sentència a l’art 31A(1), no és essencial que les parts s’hagin reconciliat, tot i que, sense cap mena de dubte, normalment aquest serà el cas. No obstant, les subseccions (2), (3) i (4) otorguen poders adicionals al tribunal, i està establert per la sibsecció (6) que el tribunal no pot dictar aquestes sentències excepte si sembla que hi hagi hagut una reconciliació entre les parts del matrimoni.
L’apartat (2) estableix que si el tribunal modifica o anul•la una sentència del paràgraf (a) (ie sentència d’una quantitat global) pot ordenar que es torni a pagar una quantitat igual al total o qualsevol part de la quantitat global. L’únic comentari que es pot fer sobre això és que, donat que les parts s’han reconciliat i fan una sol•licitut conjunta, un es pregunta perquè aquesta disposició es creu que és necessària i a qui va destinada a ajudar.
6.25 l’apartat (3) relon de la posició en que el tribunal modifica o discharges una sentència del paràgraf (c) (ex. Una sentència de liquidació de la societat de guanys), i quan entra en vigor. Aquí el tribunal pot:
(a) ordenar a qualsevol persona a qui se li hagi transferit la societat en compliment a la sentència del paràgraf (c) per transferir-
(i) la societat total o qualsevol part d’aquesta, o
(ii) qualsevol societat total o qualsevol part d’aquesta que davant del tribunal representi aquesta societat;
A favor d’una de les parts del matrimoni o un fill/a de a familia, o
(b) modificar qualsevol propietat/vinculació la qual la sentència digui que va a favor de qualsevol persona o abolir o reduir qualsevol interès de la persona a aquesta propietat”.
L’apartat (4) és una disposició vinculada, desde que estableix que allà on el tribunal actui a l’apartat (3), pot:
“exposar una disposició complementaria (incloent una sentència de liquidació de societat de guanys posterior o una sentència pel pagament d’una quantitat global) si pensa que és apropiada com a conseqüència de presentar qualsevol traspàs/cessió, modificació, abolició o reducció a el paràgraf (a) o (b) d’aquesta apartat.
6.26 Altra vegada, és difícil concebrer les circumstàncies en que s’invocaran aquestes disposicions. L’apartat només pot entrar en vigor quan s’hagi satisfet al tribunal de que les parts s’han reconciliat i amb una sol•licitut conjunta. Fins i tot, reconèixer que hi pot haver casos en que les parelles reajuntades penses que és prudent desfer els requisits legals que se’ls han imposat prèviament, un pot pensar que hi ha un grau d’exageració a l’hora de fer noves sentències de liquidació de societat de guanys per reflectir el procès de liquidació que han acordat.
6.27 Finalment, l’apartat (7) estableix que el tribunal no hauria de dictar cap sentència a l’apartat (3) o (4) above a no ser que sembli que la sentència no perjudicarà els interessos de cap fill/filla de la família o qualsevol persona que hagi adquirit el dret o interès en conseqüència de la sentència de liquidació de la societat de guanys i no és una part del matrimoni o un fill/a de la família.
Pensions
6.28 Les disposicions de la Llei de Pensions de 1995 tenia la intenció de donar al tribunal el poder per destinar que es portessin a terme els pagaments de les pensions en benefici del cònjuge divorciat respecte a les peticions a el o a partir de l’1 de Juliol de 1996: veure par 5.14 above; però en el curs dels debats parlamentaris del Projecte de Llei del Codi de Família, el Govern va haver d’introduir sota pressió renovada mesures efectives allà on les expectacions de les parts sota els règims de pensions podien tornar a assignar-se al divorci. Es va vèncer al govern en una divisió (veure Informe oficial (HL) de 29 de Febrer de 1996) i es va presentar una esmena al projecte de Llei. No obstant, tal com va suggerir el Ministre de l’Estat del Departament de Seguretat Social, aquesta esmena expressava els principis però no tenia els mitjans per posar-los en pràctica; i es va presentar a la cambra dels Comuns una disposició posterior (ara la trobem a l’art 16 de la Llei) per intentar tenir els mitjans, tot i la manca d’una política completa en algunes qüestions importants, a l’hora de donar al Jutge President del Tribunal Constitucional i Suprem els poders per dictar normes/lleis, i extendre fins i tot el poder d’esmenar la legislatura primària. El Ministre d’Estat va deixar clar que era un procediment insatisfactori, i que necessitaria una altra legislatura primaria (veure Informe Oficial (HL) de 27 de juny de 1996, col 1090). La posició és, per tant, que el govern ha afirmat que estpa “totalment destinat al principi de la divisió de pensions”; el juny de 1996, el Govern va publicar un llibre de consulta “The Treatment of Pension Rights on Divroce” (tractament de les Lleis de Pensions en el Divorci) (Cm 3345) i buscava opinions en un ampli ventall de qüestions. Es pensa publicar, en el degut moment, una Proposta de Llei que contingui el paquet complet de les propostes polítiques, “seguides per una legislació tan bon punt sigui practicable” (ibid). El principi de divisió de pensions s’ha preservat de cara al Projecte de Llei, però sembla cert que les disposicions que finalment governaran aquesta complexa qüestió seran diferents d’aquelles de l’art 16. En les presents circumstàncies, no es proposa comentat els detalls de l’article (que sembla inadequat a l’hora d’aconseguir els objectius dels seus promotors).
Conducta
6.29 Abans de que entri en vigor la Llei, es va resoldre satisfactòriament l’enfocament sobre la rellevància de la conducta de les parts en relació a la pensió compensatòria, i la conducta només era un tema en els casos relativament extranys en els que seria inquitable no fer-ne cas. És possible que aquesta actitut pugui haver de canviar, degut a l’esmena de l’art 25 de la LLCM de 1973 portada a terme per la llei.
Durant els debats de la Llei de 1996, va quedar clar que hi havia una opinió entre alguns membres del Parlament de que els tribunals no li donaven importància a la conducta que consideraven que havia de tenir. El Secretari Parlamentari del Departament del Jutge President del tribunal Constitucional i Suprem va afirmar que “l’evidència anecdòtica” suggeria que “si es tenia en compte la conducta” només considerava normalment la conducta del natural econòmic (Informe Oficial (HC) 16 de Maig de 1996, col 371). Els ministres prèviament s’oposaven amb èxit als intents per realçar la conducta, però en la Cambra dels Comuns, en la segona Lectura, el ministre es va veure obligat a reconèixer que la pràctica del tribunal no satisfeia a tothom i que la conducta era “extremament imortant” Informe Ofixial (HC) 25 de Març de 1996, col 738).
Com a conseqüència, el Govern va presentar una esmena a l’art 25 (g) que afegia les paraules, després de les parts:
“qualsevol natura de la conducta i el que hagi passat durant el matrimoni i després de la separació de les parts o (com es pot donar el cas) la dissolució i anul•lació del matrimoni.
Quan es va proposar aquesta esmena, el Secretari Parlamentari va dir que el propòsit de l’esmena era:
“s’ha de tenir en compte que la conducta de les parts de qualsevol natura, seria inequitable passar-ho per alt, i que no només s’ha de considerar la conducta durant els procediments de la compensació auxiliar”. (Sr. Jonathan Evans (comitè Permanent ???, Informe Oficial (HC) 16 de Maig de 1996, col 971).
És dificil preedir el probable impacte d’aquesta esmena en la proposta dels tribunals. Per una banda, es pot dir que es va dissenyar l’esmena per aclarir, més que canviarr, la llei. Per altra banda, es pot suposar que el Parlament ha d’haver intentat canviat la llei en alguns sentits. Sembla cert que aquestes esmenes animaran els litigants a persistir a l’hora de fer al•legacions de conducta en circumstancies en les que se’ls ha avisat formalment de que no tindria sentit fer-le.
Procediments
6.30 No hi ha res a la Llei de 1996 que regeixi els tràmits com aquest, i aquest serà el tema de les esmenes de FPR de 1991. No obstant, és possible especular sobre els canvis que és probable que es facin.
No hi ha cap prohibició per expedir una sol•licitut de compensació econòmica en qualsevol nivell, és més el fet de que s’hagin de completar tots els tràmits dins del període de reflexió i consideració, que ha de ser de com a mínim 9 mesos, serà un estímul per les parts a l’hora de tramitar la seva litigació sense espera. Hi ha disposicions que nomñes permeten cursar una sol•licitut després de dictar una sentència de divorci amb el consentiment del tribunal, però estan destinades a assegurar que hi ha alguna finalitat, i que les parts no presenten cap acord fals per obtenir el divorci i llavors buscar demanar la litigació posteriorment. L’emfasis és, per tant, tirar els tràmits endavant i completar-los dins del període.
6.31 Els tràmits per la compensació econòmica només es poden iniciar quan existeixen tràmits matrimonials, que es fa després d’omplir la declaració. No es pot omplir la declaració fins 3 mesos despr´´es de la trobada informativa, que deixa un possible buit per aquells sol•licitants que necessiten una pensió compensatòria urgent. Aquest sol•licitant haurà de sol•licitar al tribunal de magistrats, o al tribunal local a l’art 27 de la LLCM de 1973. Pot ser que les recomanacions que sorgeixen d’aquests pilots d’hagin fet en el moment en que la llei entra en vigor.
