Это было удивительное и небывалое доселе событие, потому что ранее никому - ни Богу, ни человеку - не удавалось обратиться к миру аналогичным образом – через учение аспектам четырех благородных истин.
Кроме того, колесо Дхармы, раскрученное Буддой, исключительно. Оно дает возможность [для опровержения], требует интерпретации и служит основой для разногласий.
Основываясь только на отсутствии реальной сущности явлений обусловленного мира и на том, что все в нем не имеет начала и конца, а также на отсутствии возмущений и на спокойном отношении к невзгодам, Будда совершил второй поворот колеса дхармы. Слева лёгкое уменьшено в объеме, верхняя доля уплотнена, пневмотизированная лёгочная ткань не визуализируется. На фоне уплотнённой лёгочной ткани определяются деформированные просветы бронхов и осумкованная полость размером 31 на 24 мм. жидкостной плотности. Левый главный бронх деформирован, сужен. В нижней доле слева фиброзные изменения в проекции S8,9. В правом лёгком верхняя доля вздута, пролабирует в левую половину грудной клетки. Нижняя доля вздута, легочной рисунок деформирован в проекции S9, элементы легочного рисунка сближены. Средостение смещено влево.
При болюсном контрастировании выполнен легочный ствол, правая и левая лёгочные артерии. Ширина легочного ствола 23 мм. а.pulmonalis dextra15 мм, а.pulmonalis sinistra 11 мм. Слева ветви а.pulmonalis sinistra c обеднённым периферическим кровотоком. Васкуляризация сегментов S 1-2, 3 отсутствует. Справа ветви pars basalis сближены, деформированы.

The diaphragm is positioned normally, the contours are distinct and even. The sinus on the right is free, the left one is obliterated. The right lung is compensatory swollen, on the left there is atelectasis of the superior lobe, without visible focuses and infiltrations. The lung pattern is evidently deformed by the fibrosis changes, and some single bronchiectases are defined on the left. Roots are not structural, mediastinum is shifted to the left.
Chest Computer Tomography, pulmonary angiography of 25, May, 2017 - Thorax and pulmonary fields are not symmetrical. The front axis of the spine is curved. There are no focal and infiltrative changes in the lungs. On the left, the lung is reduced in volume, the superior lobe is indurated, and the pneumaticity pulmonary tissue is not rendered. The deformed lumens of bronchi and the encapsulated liquid density cavity of 31 x 24 mm are defined at the background of indurated pulmonary tissue. The left primary bronchus is deformed and constricted. The inferior lobe has fibrosis changes in the S8,9 projection. In the right lung the superior lobe is swollen and it prolapses into the left half of the thorax. The inferior lobe is swollen, the lung pattern is deformed in the S9 projection, the elements of lung image are narrowed. Mediastinum is shifted to the left.
The bolus tracking was applied to a pulmonary trunk, and to the right and the left pulmonary arteries. The width of the pulmonary trunk is 23 mm. a. pulmonalis dextra is 15 mm, a. pulmonalis sinistra is 11 mm. The left a. pulmonalis sinistra branch’s peripheral blood flow is depleted. Segments’ 1-2,3 vascularization is missing. The right branches of pars basalis are narrowed and deformed.

Логотипы на изъятых чушках могли быть оставлены как изложницами, находящимися в производстве завода ОАО «$$$», так и аналогичными изложницами, не принадлежащими заводу ОАО «$$$».
Учитывая изложенное, определить подлинность товарного знака не представилось возможным, поскольку установлено, что чушки могли быть изготовлены на мощностях различных предприятий.
Необходимо еще раз подчеркнуть, что национальными судами было установлено, что в момент рассмотрения настоящего спора у ООО «***» отсутствовали правовые основания для владения изъятым в качестве вещественного доказательства имуществом, а значит и для предъявления требования о возврате имущества либо взыскания его стоимости. Оснований для возложения на МВД России ответственности за утрату имущества не имелось, поскольку противоправные действия органов внутренних дел в рамках уголовного судопроизводства не были установлены.
С учетом изложенного, власти Российской Федерации полагают, что в настоящем деле отсутствовало нарушение прав организации-заявителя, гарантированных ст. 1 Протокола № 1 к Конвенции, и просят отклонить жалобу в соответствии со ст. 35 § 4 Конвенции.

It should be emphasised once again that the national courts found that at the material time OOO “***” had had no legal grounds for possessing the property seized as the material evidence and, therefore, for claiming to return the property or to recover its value. There were no grounds for holding the Ministry of the Interior of the Russian Federation liable for the loss of the property since unlawful actions of the law enforcement bodies were not established in the course of the criminal proceedings.
In view of the foregoing, the Government believe that there has been no violation of the applicant’s rights under Article 1 § 1 of the Convention and ask the Court to dismiss its application pursuant to Article 35 § 4 of the Convention.
