Parties who applied for divorce under the provisions of the Matrimonial Causes Act were required to come to court “with clean hands”, and (regardless of the ground for divorce relied on) had to disclose to the judge, in a sealed document called a discretion statement, any act(s) of adultery committed by them between the time of the marriage and the hearing of the petition. Such acts might result in the divorce being refused.
