Explanation:
Si tratta di un traducente un po' azzardato, quindi ho messo una confidence bassa. Ti spiego il mio ragionamento. Mi è capitato spesso di imbattermi in testi o frasi in cui l'"estate", che è a tutti gli effetti l'asse ereditario del defunto, viene trattato alla stregua di una persona giuridica. Quest'idea dell'estate come persona giuridica trova vari riscontri online, ad esempio qui: https://wa-wills.com/legal-library/glossary/estate/ "An estate is a separate legal entity that comes into existence upon a person’s death and contains all of the person’s assets and debts". Ora, la mia impressione è che l'estate inteso in questo senso sia a tutti gli effetti un trust, anche perché sono entrambe figure previste dall'equity (inteso come sistema di norme opposto alla "law" nella common law). Quest'impressione è confermata anch'essa da diversi riscontri online, ad esempio: https://rslaw.com.au/deceased-estates/
Ad esempio poi il Black's Law Dictionary (8a edizione) riporta: "equitable estate.An estate recognized in equity, such as a trust beneficiary's interest".
In altre parole è come se nella common law si desse per scontato che, quando si muore, il proprio patrimonio viene trattato alla stregua di una persona giuridica che funziona allo stesso modo di un trust.
In alternative potresti lasciare l'inglese mettendo tra parentesi "trust ereditario" come spiegazione.
