Who Are ELL Students? NCLB uses the term Limited English Proficient (LEP) and defines an ELL student as an individual who (a) is age 3 to 21 years; (b) is enrolled or preparing to enroll in elementary or secondary school; (c) was not born in the U.S. or whose native language is not English; (d) is a Native American, Alaskan Native, or a resident of outlying areas; (e) comes from an environment in which a language other than English has had a significant impact on an individual’s ELP; (f) is migratory and comes from an environment where English is not the dominant language; and (g) has difficulties in speaking, reading, writing, or understanding the English language that may deny the individual the ability to meet the state’s proficient 3 level of achievement, to successfully achieve in classrooms where English is the language of instruction, or to participate fully in society (NCLB, 2002).
