Sollte das Berufungsgericht nach erneuter Priifung von seinem bisher vertretenen Ergebnis abrucken und zu einer Auslegung des § 5 Nr. 2 III etwa im Sinne der vom Beklagten vertretenen Auffassung kommen, so *wird es weiter darauf ankommen*, ob diese Regelung eine hinreichende sachliche Rechtfertigung besitzt.

"darauf ankommen" is often translated as "to come down to", but I can't fit this phrase in here so it can sound elegant.

I have twisted it quite a bit - and am wondering if I have gone too far?

Should the court of appeal disavow the conclusion advocated to date following a review and come to an interpretation of § 5 No. 2 III more or less in accordance with the view held by the respondent, *the point that would remain to be clarified* is whether this provision has sufficient justification.

I think that weiter means "still", rather than "also" as Kim has suggested. So here are some ideas:

The question remains as to whether...
It (the appeal court) must still determine whether...

You could put all these in the future tense, as this is a hypothetical future situation, though I think the present tense works too.
