Portuguese term or phrase: eficácia

Os contratos-promessa com eficácia meramente obrigacional e com tradição da coisa, ou com eficácia real e sem tradição da coisa, por não se enquadrarem no já referido art....

I found this on the net, as far as I can see a 'contrato promessa' is a promissory note, and a 'contrato prometido' is a sale and purchase contract. It seems that for a 'prometido', the contract is only applicable to the contracting parties. But how should I translate eficacia in this context?

'O contrato-promessa, criando para o promitente uma obrigação de contratar, cujo objecto é uma prestação de facto, goza apenas, em princípio, de eficácia meramente obrigacional, restrita por conseguinte às partes contraentes, ao invés do contrato prometido, quando se trate de contrato de alienação ou oneração de coisa determinada, que goza de eficácia real.'
