على حسب أحد الملفات التي حملتها من النت فإن الاتفاق الابتدائي هو :
ثانياً – الاتفاق الابتدائي :
1- تعريفه :
إن الاتفاق مرحلة سابقة للعقد وقد لا يؤدي اليه ، أما العقد فهو نتيجة لهذا الاتفاق ، وموثق له ، إذ كثيراً ما يتفق الطرفان على تنظيم اتفاق ينص على وجوب إعداد عقد مفصل نهائياً.
وإن الاتفاق الابتدائي الذي يسبق عقد البيع النهائي المتعارف على تسميته بالقطعي ، مع تعليق تنفيذ بنوده من التزام بنقل الملكية للمشتري والتزام بدفع الثمن للبائع إلى حين تحرير العقد النهائي المبرم ، فالبائع لا يطالب بتحرير الثمن إلا بعد إبرام هذا العقد القطعي ، وكذلك المشتري لا يطالب بالفراغ أو استلام المبيع ، وينقلب الالتزام على كل منهما إلى التزام بعقد البيع النهائي ، ومن مبررات هذا التعليق، البيع الابتدائي ، أي تعليق الاتفاق إلى الوقت الذي يبرم فيه الطرفان بيعاً نهائياً قطعياً


فهل يجوز أن نسمي الاتفاق الابتدائي
