Osa üleminek
Müüja ja Ostja lepivad kokku, et lepingu eseme omand ja kõik lepingu esemeks oleva osaga seotud õigused ja kohustused lähevad Ostjale üle selle lepingu notariaalse tõestamise hetkest.
Osaühingu suhtes loetakse osa võõrandamine toimunuks ja osanik vahetunuks pärast osaühingule võõrandamisest teatamist ja osa ülemineku tõendamist.
Lepingu registreerimine
Osa võõrandaja ja omandaja on kohustatud, tulenevalt äriseadustiku § 150 lg 1, teatama osa võõrandamisest osaühingule ja esitama osaühingule ka osa võõrandamise lepingu kinnitatud ärakirja.
Äriseadustiku § 149 lg 4 kohaselt saadab osa võõrandamise käsutustehingu tõestanud notar lepingu tõestamisest alates kahe (2) päeva jooksul äriregistri pidajale justiitsministri kehtestatud vormis teate osa võõrandamise kohta.

Share transfer
